BOOKING TERMS AND PRIVACY POLICY

1 General conditions
1.1 Company data

All tours, excursions, activities, transfers and extensions will hereafter be referred to as »tours«. All bookings are made with Institute Symbiosis, social enterprise, which is the company that owns the brand Nature in colour. In these terms and conditions, we refer to Institute Symbiosis, social enterprise, as »we«.

We are a tour operator based in Slovenia. Our VAT number is SI27918351, and we are registered at the Slovenian Chamber of Commerce under number 1806963000. We perform tour operator activities under license No. 1768, issued by the Slovenian Chamber of Commerce.

1.2 Agreement

These booking terms and conditions are valid for our sheduled and custom tours. All tours, excursions, activities, transfers and extensions will hereafter be referred to as »tours«. All bookings are made with Institute Symbiosis, social enterprise, which is the company that owns the brand Nature in colour. In these terms and conditions, we refer to Institute Symbiosis, social enterprise, as »we« The person making the booking and payment is refered as »a customer« and any person participating at the tour »a participant”.

When you book with us, you agree to the Booking Terms and Privacy Policy.

1.3 Validity of these terms and conditions

These terms and conditions only apply to tours which are booked directly with us. In case you make a booking through a reseller, an agent or an online tour operator, their terms and conditions apply.

2 Guests in nature

On our trips, we are away from city noise, and for most of our participants, the quiet atmosphere is an important part of the outdoor experience. We, therefore, ask you to be quiet and talk softly. Like this, we will hear more sounds of nature and may be able to detect singing birds and other wildlife during our tours.

During our tours, we are walking on larger or smaller trails. On our routes, we pass private land and vulnerable habitats. Participants are asked to follow the trails and only step off the trails where the guide permits this.

Please note that smoking is not allowed during a large part of our nature tours. Most of our participants are non-smokers and appreciate the fresh air. If you wish to smoke during the tour, you can do so during breaks, but we ask you to stay well away from the other participants.

Participants of the scheduled tours should be over 18 years of age. In exceptional cases children can also participate, please contact us at info@natureincolour.eu for information. Dogs at scheduled tours are not allowed.  

Children are welcome at custom tours, but please check the recommended age at each tour description. We ask parents to judge if children can walk the distance of the tour. Please note that booking for children is only possible when you at the same time book for at least one adult, which then acts as their guardian. On custom tours you are also allowed to bring a dog, as long as it is kept on a leash and does not disturb wildlife.

We reserve the right to refuse participation of any person whose conduct or manner is likely to cause offence or upset other participants. In such cases, we cannot refund the participation fee.

It is not permitted to take, damage, or purposefully disturb animals and plants during our tours. In addition, please note that in Slovenia, many animal and plant species are legally protected.

3 Our tour programs

3.1 Tour data

These booking terms and conditions are part of the travel certificate as required by the Slovenian Consumers Protection Act. The data on the respective tour (itinerary, schedule, meeting point, description, and highlights) are stated on the page www.natureincolour.eu or send to you by email after the booking is made.

All the information provided on the website www.natureincolour.eu is, to the best of our knowledge or belief, correct at the time of publication. We will advise you of any changes that are fundamental to the contract, or which we believe will affect the enjoyment of the tour.

We reserve the right to change times, prices, payment, booking or discount conditions at will. Prices for coming seasons are always preliminary and can be subject to change.

 3.2 Which species do we see

During our tours, we aim to see wild animals and plants. We do not train any of these animals to come to a specific spot. Animals species which we mention in tour descriptions and announcements are those which occur in the respective areas. However, we cannot guarantee that we see all described species on each tour. Likewise, plants have distinct flowering seasons, and we will see different flowers in different seasons. Failing to see the species depicted on our photographs or described in our texts, cannot be used as a reason for making any claim for compensation for the incomplete or poor performance of our services or liability claims. No refunds can be given in this case.

3.3 Changes due to the weather

Outdoor activities are weather-dependent. If we are forced to change a tour due to extreme weather conditions, we will propose a different order of the itinerary so that we carry out the same activity on a different day. When this is not possible, we will propose an alternative program, like a visit to a nature-related museum or a cave, at no additional costs. Please note that such changes may occur at short notice, even on the same day. No other liability claims will be accepted as the weather is considered an unpredictable factor.

3.4 Tour timing and meeting point

For scheduled tours, participants should arrange their own travel to Slovenia. All travel within Slovenia is ensured by us and is included in the price.  In most cases our meeting point will be at the Ljubljana Airport (Brnik). In case this Airport is not convenient for most participants, we may agree on a meeting point on a different Aiport ( e.g. Trieste or Venezia in Italy).

For customs tours we will agree on a meeting point in the booking process. If the transport is part of the tour-package, you will be able to leave your vehicle ona free public parking, and we will continue with our vehicle. Alternatively for an additional fee we can offer a pick-up in Ljubljana or any of the bus/train stops in the vicinity. If transport is not included in the tour-package the guide will drive with own veichle, and you will be able to follow him/her. Under no circumstances our guide will be diriving in your vheilce as this may lead to unclear responsibility in case and accident.

If, due to unforeseen circumstances (e.g. traffic, getting lost) you cannot reach us by the agreed time, please contact us immediately at our contact mobile phone number ++386 41 902 110. We will make every effort to adapt our program so that we can meet you at the closest convenient point. Missing the whole or part of the tour due to your delay, regardless of the reason, cannot be used as a reason for any claim for compensation for the incomplete or poor performance of our services or liability claims. No refunds can be made in this case.

4 Booking and payment

4.1 General

If you wish to discuss any of our tours, you can contact us over enquiry form, e-mail info@natureincolour.eu. When you decide to make a booking, we will send you a booking form which should be returned by e-mail info@natureincolour.eu.

For tours with a price above 500 €, we ask for a pre-payment of at least 25 %, which should be paid at least five weeks before the start of the tour to our business account. Once the payment is made, we will send you a booking conformation. The remaining part of the tour price should be paid at least 2 weeks before then start of the tour.  

For tours with a price lower than 500 € we do not request a pre-payment. You can pay it at the beginning of the tour. Please, note that you can only pay in cash and we do not accept credit cards.

4.2 Changing your booking

If you wish to change your booking, we will make every effort to assist, but cannot guarantee to be able to meet such requests. Requests for a change must be made by email to info@natureincolour.eu.

4.3 Cancellations by you

If you must cancel participation at the scheduled tour, please send an email to info@natureincolour.eu . We will make a refund at the following conditions:

  • No cancellation fee applies for cancellations made five or more weeks in advance.
  • A cancellation fee of 25% applies for cancellations made less than five weeks, but more than two weeks in advance.
  • No refund can be given for cancellations made less than two weeks in advance, or in case of no-show.

 

If you must cancel participation at the custom tour, please send an email info@natureincolour.eu . If a payment has been made by bank transfer, we will make a refund at the following conditions:

  • No cancellation fee applies for cancellations made 10 or more days in advance.
  • A cancellation fee of 25% applies for cancellations made between 9 and 1 days in advance.
  • No refund can be given for cancellations made less than 24 hours in advance, or in case of no-show.

4.5 Cancellations by us

On our scheduled tours, we guarantee the departure when we have at least three bookings. At latest five weeks before the departure date, we either confirm the tour or we cancel the tour in the case of underbooking. In case we have to cancel a tour, you will receive a full refund of the payment which you transferred to us. Please note that airplane fees or any other costs are not included in the tour price and will not be refunded. Allow us five working days to process the bank transfer.

In case the cancellation of the scheduled tour is made by us later than five weeks due to unforeseen circumstances, we may have to decide to cancel the tour. If a payment has been made, you will receive a full refund. The whole paid sum of tour costs will be transferred back to the account which you used for payment. Please allow us five working days to process the bank transfer.

In case the cancellation of the custom tour is made by us, for instance, due to unforeseen circumstances or unfavourable weather, we may have to decide to cancel the custom tour. If payment has been made, you will receive a full refund. The whole paid sum of tour costs will be transferred back to the account which you used for payment. Please note that we will not refund any costs which were not part of the tour price. Allow us five working days to process the bank transfer.

5 Your obligations as a tour participant

Please remember that our only way to contact you is through the address and contact details which you provide us with when you make a booking.

Please read your confirmation carefully and check that all dates/times and products/services are according to your requirements. If not, please contact us to correct any misunderstandings as soon as possible. Follow any rules and instructions that apply to the use of accommodation, transfer, activity, etc. You are liable for all damage that results from your or your company’s careless behaviour to Institute Symbiosis’s property.

When you make your reservation, please let us know if you have any disabilities, illnesses or allergies that might be important for us to know about. Please be specific of what kind of special needs you might require before arrival.

6. Insurance and liability

6.1 Accident insurance

The prices of our tour arrangements, unless differently stated in the program, include basic accident insurance for the duration of the tour. At the start of the tour, each participant will receive a ticket which is proof of participating in the tour. This ticket is also proof that you are covered by our basic accident insurance, please keep it until the end of the tour. On request, we can send you the Terms and Conditions of our accident insurance by e-mail.

If an accident happens during the tour, the participant should immediately inform the guide. The accident should be reported before the end of the tour, and the participants and the guide should together fill in an accident report form which will then be submitted to the insurance company.

Any claims made after the end of the tour will not be taken into account.

Note that this insurance does not include health insurance, which means that the participants are responsible for taking care of their own health insurance. When travelling abroad, it is recommended to get health insurance with global coverage.

6.2 Liability

We promise to ensure that the tour arrangement will be performed with reasonable skill and care. This means that, subject to these booking conditions, we will accept responsibility in the case, you suffer death or personal injury, as a result of the failure of ourselves, our employees, agents or suppliers to use reasonable skill and care while carrying out the tour.

Please note that it is the responsibility of the customer or the participant to show that reasonable skill and care has not been used if you wish to make a claim against us. Also, we will only be responsible for what our employees, subcontracted guides and suppliers do or do not do if they were at the time acting within the course of their employment (for employees) or carrying out work we had asked them to do.

We will not be responsible for any injury, illness, death, loss (for example loss of enjoyment), damage, expense, cost or other sum or claim of any description whatsoever which results from any of the following:

  • the act(s) and/or omission(s) of a third party not connected with the provision of your tour;
  • consequences of circumstances which were unforeseeable or unavoidable and which fall under force majeure, including, but not limited to, natural disasters, epidemics, strikes, political unrest and war.

Please note, we cannot accept responsibility for any services which do not form part of our contract. This includes, for example, any additional services or facilities which any other supplier agrees to provide for you where the services or facilities are not advertised in our brochure or on our website, and we have not agreed to arrange them and any tour you purchase.

Please note, we cannot accept any liability for any damage, loss, expense or another sum(s) of any description:

  • which on the basis of the information given to us by you concerning your booking prior to our accepting it, we could not have foreseen you would suffer or incur if we breached our contract with you;
  • which did not result from any breach of contract or other faults by ourselves or our employees or, where we are responsible for them, our suppliers;

Additionally, we cannot accept liability for any business losses.

 7. Complaints and disputes

Any inconveniences which may occur during your stay must be reported immediately to your tour guide or organizer. If you have not reported any complaints during your stay and therefore neglected to give us the opportunity to correct these mistakes, you cannot demand any compensation afterwards. If you are not satisfied with your compensation, you have to notify us in writing within 14 days after the end of your tour. In the event of a dispute between the customer and us or the participant, the legal procedure is in the competence of the court in Ljubljana, Slovenia.

8. Privacy Policy

This policy applies only to the Nature in colour website (www.natureincolour.eu) and to the tours organised under the brand Nature in colour. It does not apply to any other websites to which we provide links.

8.1 Collection of personal information

We will only collect personal information from you which you provide voluntarily, either when you fill out an enquiry or booking form through emails. We need these data so we can effectively respond to your request. Please do not submit your personal data to us if you do not want us to collect them. Data which we collect from you are, for instance:

  • Your name, address, telephone number and email address
  • Date of birth
  • Payment details
  • Dietary information (allergies and preferences like vegetarian food, if you are willing to share these data)
  • Necessary medical data (if you are willing to share these data)
  • Data on the booked tour
  • Name of your insurance agent and policy number of your travel insurance agent
  • If you submit feedback to us through our feedback form then we may collect this information to help us with our services
  • Possible remarks, complaints and claims regarding tours in which you have participated.

8.2 The use of personal information

When you provide personal data, you agree that we use your personal information so we can optimise our tours, provide you with customised tours and that we use your data for our internal business purposes. This includes (without limitation):

  • Enabling us to complete your tour booking.
  • To inform you about changes to our products, services or offers which you might find interesting.
  • For strategic development and market research purposes.
  • Compiling customer reviews.
  • For accounting purposes.
  • For any purpose required by law or regulation.

8.3 Sharing information

Your personal data will only be shared with third parties when this is necessary for organising our tours, in case of emergencies and when legally required. Examples are:

  • Sharing anonymous data on dietary requirement and preferences with providers of meals for the preparation of the tour.
  • Sharing your name, nationality and birth date with authorities for taxation purposes (Tourist Tax).
  • In the case of legal disputes, sharing data with legal authorities and insurance companies.
  • In case of an accident or medical emergency, we share medical data with medical authorities, including doctors and first-aid workers.
  • If this is formally requested from us, we share data with the police and other governmental bodies who represent the law.

8.4 Storing information

We store your personal data up to two years after the tour in which you participated, with an exception in the case of claims against us. In this case, we may store your personal data longer, with a maximum of two years after the claim is settled. We delete your data earlier if you ask us to do so. However, in this case, you cannot make any claims against us. 

8.5 Photographs, taken during the tour

At the start of a tour, we may ask you to sign permission for the use of photographs or video-recordings which we take during the tour. We use these photographs and videos for promotional and commercial purposes. We do not make, store or use any photographs from which we can reasonably assume that the photographed persons will be uncomfortable with being shown in a particular way.

8.6 Monitoring emails

We may keep records of email messages which you send to us and of other communications with you, in accordance with this policy.

9. Cookies policy

A cookie is a small text file that is placed on your computer’s hard drive by your web browser when you first visit our site. This cookie allows us to identify your computer and find out details about your latest visit. The information which we collect through cookies is anonymous. This includes general information about your computer settings, your connection to the internet e.g. operating system, internet browser, IP address, timings of browsing on our website and your geographical location. For further information visit www.aboutcookies.org.

Usually, you can alter the settings of your browser to erase cookies or to prevent automatic acceptance.

10. Google Analytics

We use Google Analytics, which help us to understand how our website is being used. With these statistics, we can improve the user experience. User data are anonymous. Google Analytics is a tool which is commonly used on many other websites. The cookies which we use include: _utma, _utmb, _utmc and _utmz.

11. Safeguards and security

No data transmission over the internet can be entirely secure and therefore we cannot guarantee the security of your personal information and/or use of our website. However, we use reasonable endeavours to protect the security of your personal information from unauthorised access.

In addition to our safeguards, your personal information is protected in Slovenia by Regulation (EU) 2016/679  of the European Parliament. This means that the information which we hold about you should be processed fairly and lawfully and should be accurate, relevant and not excessive. The information should, where necessary, be kept up to date and not retained for longer than is necessary.

11. Changes & accessing your information

Please help us to keep your personal information accurate by updating your details by email or via the contact

You keep the right to:

  • Access your personal information and correct mistakes.
  • Ask that we remove your personal information when we no longer need it for the above-stated purposes.
  • Cancel your permission for the use of your personal information.
  • Submit a complaint at the Information Commissioner in Slovenia.

These Booking terms and Privacy Policy may change without prior notice. Please check this page from time to time to make sure that you agree with our policies.
